This Criminal Original Petition has been filed seeking for a direction to the second respondent to complete the investigation and file a final report in Crime No.29 of 2023.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.

3. Learned Additional Public Prosecutor on instructions submitted that there was a case in counter and that in the counter case, the investigation was completed and final report has been filed. Insofar the case in hand, viz., Crime No.29 of 2023 is concerned, it has been closed as 'Mistake of Fact'. Learned Additional Public prosecutor submits that RCS notice will be served on the petitioner by this week.

4. In the light of the above development, if the petitioner is aggrieved by the closure of the case, it is left open to the petitioner to agitate the same by way of filing a protest petition before the concerned Court.
