O R D E R

Learned counsel for the respondent states that there was some delay in submitting the panel of three retired Chief / Superintending Engineers and in the meantime, the petitioner approached this Court. 2.After some arguments, it is agreed that a retired Civil Engineer may be appointed as the Sole Arbitrator to enter upon reference and adjudicate the disputes inter se the parties and that the arbitration proceedings be held under the aegis of the Madras High Court Arbitration Centre and the parties be governed by the Rules of the Centre. 3.I, thus, appoint Mr.S.Arunachalam, a retired Chief Engineer, Highways Department, No.59, III Street, Sowmya Nagar, Medavakkam, Chennai 600 100, Mob.No.: 98408 51991, as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties. As requested, the arbitration proceedings will be conducted under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre.

4.The original petition is, accordingly, allowed, leaving the parties to bear their own costs.
