PRAYER: The Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd respondent police investigate the matter in Crime No.143 of 2010, on the file of Mangalam Pett Police Station, Virudhachalam, Cuddalore District and file a final report before the concerned jurisdictional Judicial Magistrate. This Criminal Original Petition has been filed to direct the 2nd respondent police investigate the matter in Crime No.143 of 2010, on the file of Mangalam Pett Police Station, Virudhachalam, Cuddalore District and file a final report before the concerned jurisdictional Judicial Magistrate. 2.When the matter is taken up for hearing, Mr.V.Meganathan, learned Government Advocate (crl. side) would submit that after the completion of enquiry, the case in Crime No.143 of 2010 has been conducted and the same has been closed as mistake of fact and the copy of the RCS notice has also been served on the petitioner on 07.07.2020.

3.At this juncture, learned counsel for the petitioner would submit that the petitioner has not received RCS notice. 4.In view of the above, direction is issued to the second respondent to furnish the copy of the RCS notice within a period of two weeks from the date of receipt of a copy of this order. On such receipt, the petitioner is at liberty to challenge the same by filing appropriate protest petition before the jurisdictional Court as per the mandate of Hon'ble Apex Court in the case of "Union Public Service Commission Vs. S.Papaiah and others" reported in (1997) 7 SCC 614.
