Crl.O.P.No.15227 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Sathish Kumar, who was arrested and remanded to judicial custody on 10.06.2023 registered for the offences punishable under Sections 8(c) read with Section 20(b)(ii)(B) & 29(1) of NDPS Act in Crime No.510 of 2023 on the file of the respondent police seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated in a case registered for the offences under Sections 8(c) read with Section 20(b)(ii)(B) & 29(1) of NDPS Act in Crime No.510 of 2023. Petitioner is in Judicial Custody from 10.06.2023. Thus, he seeks bail to the petitioner.
3. In response, learned Government Advocate (Crl. Side) submitted that, 1st accused is a tenant under one Karpagam. Karpagam's husband was running scan centre. 1st accused was appointed in the scan centre for the purpose of getting patients for determining the gender of 1/3
the foetus. He further submitted that for illegal running of scan centre for ascertaining the gender of the foetus, a case in Crime No. 347 of 2023 was registered against Karpagam, Sathish Kumar and others. In the said case, Karpagam gave a confessional statement stating that determination of the gender of the patients was done in co-operation with the 1st accused. Therefore, in retaliation, 1st accused had purchased the ganja from A5 and given it to A3 & A4 for keeping it in the house of the Karpagam. Accordingly, ganja weighing 4kg was kept in the water tank. It is also evident in the CCTV footage. Investigation in this case is pending.
4. Considering the nature, facts and circumstances of the case and that the investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original Petition is dismissed. 12.07.2023 Sma 2/3
