This Civil Miscellaneous Petition is filed to restore the petition in S.A.No.924 of 2013 by setting aside the order dated 03.02.2020 which was dismissed for non-prosecution.

2. Despite strict opposition by Mr.P.Mani, the learned counsel for the respondents, I am convinced with the reasons stated in the affidavit.

3. The appeal has been pending before this Court for quite some time and came to be dismissed for default on 03.02.2020.

4. Being satisfied with the reasons stated in the affidavit filed along with this petition, this civil miscellaneous petition is ordered and the second appeal is restored.

5. List the second appeal for final disposal on 01.02.2024.
