The suit had been filed seeking partition and separate possession of the properties mentioned in the schedule to the plaint. There are three items of properties in schedule A. Item Nos.1 and 2 are situated outside the jurisdiction of this Court and item No.3 is situated within the jurisdiction of this Court. Since part of cause of action had arisen within the jurisdiction of this Court, this application has been filed seeking leave to institute the suit.

2.In view of the above facts, leave is sought. Leave is granted. This application is allowed.
