ORDER : The Court Made the following order :- The petitioners who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 406, 420 and 506(1) of I.P.C. in Cr.No.17 of 2021 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the petitioners along with the other accused are alleged to have received a sum of Rs.7,06,738/- from the defacto complainant assuring that they will secure a job in Canada and thereafter did not secure the job and when the defacto complainant demanded the amount, the accused only returned a sum of Rs.2,06,738/-.

3.The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution. The learned counsel further submitted that visa was https://hcservices.ecourts.gov.in/hcservices/

taken in favour of the defacto complainant, however, the defacto complainant did not utilize the opportunity and further submitted that the amount received is only Rs.2,06,738/- and the said amount was returned to the defacto complainant.

4.The learned Government Advocate submitted that the accused are alleged to have received a sum of Rs.7,06,738/- and returned only a sum of Rs.2,06,738/-.

5.Considering the fact that in the recent past these types of offences have increased and the gravity of the offence committed by the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
