310/00618/2017 dated 25.04.2017, quash the same as being contrary to service law jurisprudence and the law laid down by the Hon'ble Apex Court in Capt.M. Paul Anthony 1999 (3) SCC 679 in the circumstances of the case.

This writ petition is filed challenging the interim order granted by the Central Administrative Tribunal in Original Application No. 310/00618/2017 dated 25.04.2017 to the effect that the enquiry proceedings shall be kept in abeyance till all the mahazar witnesses are examined.

2.When the writ petition is taken up for hearing today, it is represented by the learned counsel for the respondent that the original application in O.A.No. 310/00618/2017 itself has https://hcservices.ecourts.gov.in/hcservices/

been withdrawn by the applicant/respondent herein and besides, the respondent is no more.

3.In view of the above submission made by the learned counsel for the respondent that the main case before the Tribunal has been withdrawn, no further adjudication is required in this writ petition, which is filed challenging an interim order passed in the main O.A. and the writ petition is dismissed as infructuous.
