O R D E R

The Petitioner while serving as a Head Constable with the Respondents Department, was convicted on 13.10.2010 and was therefore dismissed from service on 12.11.2011. The Petitioner had challenged the order of conviction before this Court. This Court had set aside the order of conviction with a direction to reinstate the Petitioner into service forthwith with all benefits. Thereafter, the Department had also filed SLP before the Hon'ble Supreme Court, which was later dismissed. Pursuant to the above said order, the Petitioner was directed to be

reinstated with all attendant benefits. However, by the time, the order came to be passed by the Hon'ble Supreme Court, the Petitioner attained the age of super-annuation.

It is the case of the Petitioner that some of the service benefits have not given to the Petitioner, though the other persons who were involved in the above said crime have been given such benefits. It is the case of the Petitioner that the Petitioner sent the several representations and despite the same, the Respondents have not passed any orders. It is the case of the Petitioner that all the attendant benefits as a Special Sub Inspector of Police ought to have been granted to the Petitioner on his being directed to reinstated since the Petitioner's representations have not evoked any response, the Petitioner is entitled for the relief as prayed for.

The learned counsel for the Petitioner, therefore prays that this writ petition may be disposed by directing the Respondents to consider and pass an appropriate orders of the Petitioner's representations dated 05.03.2021 and 22.07.2021 within a period of twelve weeks. There is substantial force in the submission of the learned counsel for the Petitioner.

4. This writ petition is therefore disposed of by directing the Respondents to consider the representations dated 05.03.2021 and 22.07.2021 of the Petitioner and pass an appropriate orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order.
