Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to conduct land survey and fix the boundaries to the petitioners property measuring 0.15.50 hectare comprised in S.F.No.256/1C3, Nagarkoodal Village, Nallampalli Taluk, Dharmapuri District by considering his online application No.2025/0123/05/010969 dated 06.05.2025 with police aid for survey and fencing the property by considering his representation dated 06.05.2025. ORDER

By consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself.

The present writ petition has been filed praying for a writ of mandamus to direct the first respondent to conduct land survey and fix the boundaries to the petitioner's property, measuring 0.15.50 hectare, comprised in S.F.No.256/1C3, Nagarkoodal Village, Nallampalli Taluk, Dharmapuri District, by considering his online Application No.2025/0123/05/010969 dated 06.05.2025, with police aid for survey and fencing the property by considering his representation dated 06.05.2025.

3. It is submitted by the learned counsel for the petitioner that petitioner had made an online application to the first Page No.2 of 6

respondent to survey the subject property, however, the first respondent has not surveyed the property. It is further submitted that the petitioner made a representation on 06.05.2025 to the first respondent, to survey the subject property with police aid, but the same has not been considered by first respondent. Aggrieved by the same, the petitioner has filed this writ petition.

At the outset, Mr.S.J.Mohamed Sathik, learned Government Advocate appearing for the first respondent, would submit that the representation made by the petitioner would be considered and a survey would be conducted on the petitioner's land, if otherwise in order, and a report would be submitted within a time frame that may be fixed by this Court. This is accepted to by the learned counsel for the petitioner.

In view thereof, the present writ petition stands disposed of with directions to the respondents to consider the representation of the petitioner and survey the petitioner's land by fixing the boundary lines and submit a report within a period of 8 weeks from the date of receipt of the uploaded copy of this order, after putting Page No.3 of 6

the petitioner and other interested parties/stake holders on prior notice.

6. If need arises, it is open for the petitioner to seek assistance of the police and if any such request is made, adequate police protection shall be provided by the second respondent. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. There shall be no order as to costs.
