ORDER

This writ petition is filed for the following relief: "directing the respondents to disburse the belated payment of interest amount of Provident Fund, Gratuity & Earned Leave Salary amounts and other unsettled benefits such as Arrears of Leave Surrender while in service, 12(3) wage settlement arrears, Pension Arrears and DA Arrears with effect from 01.07.2022 within the stipulated time."

2. Heard the learned counsels appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. It is the case of the petitioner that he joined as a Technical Assistant in the respondent Corporation and retired from service on 30.06.2022. It is the contention of the petitioner that he is entitled to interest for the belated payments of terminal benefits and other unsettled benefits and arrears amount as per Section 12(3) settlement. Therefore, the petitioner had made a representation to the respondent to pay him the interest for the belated payment of provident fund, gratuity and earned

leave salary and the unsettled arrears of leave surrender, arrears amount as per 12(3) settlement, pension arrears and DA arrears with effect from 01.07.2022. However, the same had not been considered to date by the respondent. Hence, the petitioner is before this Court.

Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation has not been considered to date by the respondents, a mandamus, is therefore, issued to the respondent to pay the interest at the rate of 6% p.a., for the belated payment of the petitioner's Provident Fund, Gratuity & Earned Leave Salary and disburse the unsettled benefits arrears of Leave Surrender while in service, 12(3) wage settlement arrears, Pension arrears and DA arrears with effect from 01.07.2022 along with interest at the rate of 6% per annum, within a period of one month from the date of receipt of a copy of this order.
