ORDER

(This case has been heard through video conference) Criminal Original Petition has been filed to direct the respondent to complete the investigation and file the final report in Crime No.678 of 2019 pending on the file of the respondent within a time frame as stipulated by this Hon'ble Court.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing on behalf of the respondent police.

3. The learned counsel for the petitioner would submit that though the respondent has registered a case in the above said crime number on 20.10.2019, no final report is filed till date. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police would submit that in this case, F.I.R. No.678 of 2019 was registered on 20.10.2019 for an offence under Sections 147, 148, 294(B), 323, 324 and 506(2) I.P.C. On completion of investigation, the case has been closed as "mistake of fact" on 20.10.2019 and the RCS notice and report is yet to be served on to the petitioner. He would submit that shortly, it would be served.

5. Recording the same, this Court directs the respondent police to serve the RCS notice and report to the petitioner and thereafter, it is for the petitioner to approach the concerned jurisdictional Magistrate to file his protest petition, if he is so advised.

6. With the above direction, this Criminal Original Petition is disposed of.
