ORDER
The writ petition has been filed to issue a writ of mandamus to disburse 6% interest to the petitioner for the belated payment of difference amount of Earned Leave Salary by considering his representation dated 17.11.2025, within the time frame fixed by this Court.

The case of the petitioner is that he joined the services of the respondent-Corporation as Junior Assistant on 18.05.1983 and had retired from service as Assistant Manager on 30.04.2017, on attaining the age of superannuation. The petitioner would submit that 7th Pay Commission's revised scale of pay and recommendations was implemented in the State Transport Corporation on 01.01.2017. However, the petitioner who had retired on 30.04.2017, had not been paid his terminal benefits based on old scale of pay. Thereafter, based on his requests, the respondent Corporation had paid the difference amount of commutation of pension, but had not paid the Gratuity, Earned Leave Salary, which according to the petitioner was Rs.1,10,680/- despite his representation dated 27.12.2023. Therefore, the petitioner had approached this Court in W.P.No.
5057 of 2025 and obtained an order of this Court on 14.02.2025, directing to disburse the said sum along with interest at the rate of 6% on the said amount.
Contempt Petition No.2360 of 2025 by the petitioner. Thereafter, the respondents had agreed to pay the difference amount of Earned Leave Salary in five monthly instalments, starting from April 2025 onwards and the same was paid. Now the grievance of the petitioner is that despite the orders of this Court to pay 6% interest on the belated payment of difference amount of Earned Leave Salary, no interest has been paid by the respondents till date. In this regard, the petitioner had also submitted his representation dated 17.11.2025. However, the said representation is not considered to date. Hence, the petitioner is before this Court.
3. Heard the learned counsel for both sides and perused the materials available on record.

Taking into account the fact that the respondent had failed to comply the orders of this Court in entirety, this Court directs the respondent to consider the representation of the petitioner and to disburse 6% interest on the belated settlement of difference of Earned Leave Salary, which the petitioner is entitled to, from the date of retirement till the date of actual disbursal of the amount, within a period of six weeks from the date of receipt of a copy of this order.
