O R D E R

The relief sought for in this writ petition is for a direction to direct first respondent to receive the petitioner's disciplinary proceedings file number in P.R.No.99/96 from the second respondent and to dispose of the representation of the petitioner dated 13.09.2006 and 15.12.2009 in respect of this service benefits.

2.The learned counsel appearing for the writ petitioner

states that the writ petitioner is working as Grade I Police Constable in the Railway Police Station, Thiruvarur. On account of certain allegations, Disciplinary Proceedings were initiated against the writ petitioner.

However, even after the reinstatement of the writ petitioner in service his service benefits were not settled. In this view of the fact, the files relating to the Disciplinary Proceedings in P.R.No.99/96 has not been given back to the original authority by the second respondent.

3.The learned counsel for the writ petitioner further states that the entire files are now lying with the Department of Vigilance and Anti-Corruption. Only after receiving the same, the first respondent extend all service benefits to him. In this regard, he has submitted a representation to the first respondent on 13.09.2006 and on 15.12.2009.

4.Thus, without going into the merits, the first respondent is directed to consider the representations submitted by the writ petitioner on 13.09.2006 and 15.12.2009 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copy of the representation along with the order passed in this writ petition.

5.Accordingly, the Writ Petition stands disposed of. However, there is no order as to costs.
