O R D E R

The petitioner has filed this petition to direct the respondents 1, 2 and 3 to take appropriate criminal action against the 5th respondent in terms of the judgment rendered by the Hon'ble Supreme Court in Dayal Singh v. State of Uttaranchal, reported in (2012) 8 SCC 263.

2. When the Matter was listed for hearing on 20.07.2021, there was no representation on behalf of the writ petitioner and hence the matter was posted on 27.07.2021. When the matter was taken for hearing on 27.07.2021, once again there is no representation for the petitioner and in order to give one more opportunity to the petitioner, the matter was again directed to be listed on 29.07.2021 under the caption ''For Dismissal''. Today, the case is listed for hearing under the caption "for dismissal" but so also none represented on behalf of the petitioner.

3. Accordingly, this Writ Petition is dismissed for non prosecution.
