ORDER
The petitioner has come forward with the above Writ Petition praying for issuance of a Writ of Mandamus to direct the first respondent to consider the application of the petitioner and participate in the counselling under Scheduled Tribe category for the admission to the 1st year B.E. / B.Tech course for the academic year 2018-2019 (Application No.224948) and admit the petitioner by accepting the sworn affidavit of the parents under the quota reserved for Scheduled Tribes without insisting upon the production of the Community Certificate.
2. When the Writ Petition is taken up for hearing, learned Government Advocate appearing for the first respondent submitted that the Community Certificate of the petitioner, stating that the petitioner/student belongs to ST community, had been furnished through Whatsapp media.
3. The petitioner shall ensure that he gives an affidavit by enclosing the print out of the said Community Certificate by submitting the same for counselling. The respondents shall consider the candidature of the petitioner based on the said affidavit and the Community Certificate that has been received through Whatsapp media, by replacing the same with the original Community
Certificate. The learned counsel for both the respondents submitted that it is open for the petitioner/student to appear for counselling today (09.07.2018). If for any reason the Community Certificate is found to be false at a later date, the qualification obtained by the Petitioner would be deemed to be invalid.
4. With the above observations, the Writ Petition is disposed of. No costs. Consequently, W.M.P.No.20144 of 2018 is closed. 09.07.2018 Speaking Order : Yes Office to note: Issue order copy by today.
