Respondent Prayer : Transfer Civil Miscellaneous Petition under Section 24 of C.P.C., to withdraw HMOP No.67 of 2021 on the file of the Hon'ble Sub Court Thuraiyur and transfer the same to the file of Hon'ble Family Court at Chennai.

Despite service, the respondent is not appearing either in person or through counsel duly instructed.

2. The petitioner/wife seeks transfer of H.M.O.P.No.67 of 2021 on the file of Subordinate Court at Thuraiyur to the Family Court at Chennai. The transfer is sought for mainly on the ground of convenience of the wife, who is resident of Velachery. If the proceedings are transferred to the Family Court, the husband who is resident of Thuraiyur, Trichy District would be put to inconvenience, as he will have to appear in person for every hearing before the Family Court. Moreover, the wife is also a resident of Velachery, which is nearer to Sub Court, Alandur.

3. Considering the above, H.M.O.P.No.67 of 2021 is withdrawn from the file of the Sub Court, Thuraiyur and transferred to the file of Sub Court, Alandur, to be disposed of in accordance with law. Accordingly, the Tr.C.M.P.No.694 of 2021 is allowed. No costs. Consequently, connected miscellaneous petition is closed.
