This Writ Petition (Criminal) has been filed to direct the 1st respondent to issue a No Objection Certificate to the petitioner to run 'SPA' i.e. cross relaxation massage in the name and style of 'MITHRA 1/4
WELLNESS CARE' SPA at Door No.286, Vaikalpalam, Perur Main Road, Annapathai, Coimbatore District, by passing order on the petitioner's representation dated 06.12.2024.
2. It is to be noted that to run a SPA, normally licence would be given by the concerned local authority. Only for the process of such application, the local body concerned would seek no objection certificate or a report from the concerned jurisdictional police.
3. Section 108-A (2) of the Tamil Nadu Urban Local Bodies Act, 1998 deals with the same which reads as follows: 108-A. Grant of licence for spa and massage parlours:
(1) ...
(2) Any person desirous to carry on spa and massage parlour shall apply to the Commissioner for obtaining licence in such Form, in such manner and on payment of such fee, as may be prescribed.
4. Therefore, it is for the petitioner to apply such licence before the concerned local authority. Only on such application, based on the request made by the local authority, the police will verify the place in respect of which the licence is applied for including the compliance of all conditions 2/4
mentioned in the rules and give a report. Thereafter, on the basis of the report, licence would be issued.
