A.No.7050 of 2019 A.No.7050 of 2019 in O.P.(SR) No.85838 of 2019 SENTHILKUMAR RAMAMOORTHY,J This application is filed to condone the delay of 15 days in filing the petition to set aside the Award.

2. Notice was issued to the respondent on 19.09.2019 and the learned counsel for the applicant has filed an Affidavit of Service to the effect that private notice was served on the respondent on 20.09.2019. The relevant copy of the notice and the acknowledgement card are enclosed with the Affidavit of Service. However, there is no appearance for the respondent today.

3. On perusing the affidavit filed in support of the application, I find that the applicant has stated that 15 days of delay occurred on account of illhealth and consequent inability to travel Chennai. I find that the applicant has made out sufficient cause to condone the delay. 4.Accordingly, this application is allowed and the delay of 15 days in filing petition to set aside the Award is condoned.
