ORDER

The petitioners, who were arrested and remanded to judicial custody on 21.05.2026 for the alleged offences under Sections 170 of B.N.S.S., Section 7(1)(a) of the Criminal Law Amendment Act and Section 25(1)(a) of the Arms Act in Cr. No.156 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioners have possessed lethal weapon in their hands, intimidated using knife and obstructed the public and hence the case.

3. The learned counsel for the petitioners would submit that the petitioners have been remanded to judicial custody on 21.05.2026 and the allegation against the petitioners is that, they were in possession of lethal weapon in their hands. The learned counsel would further submit that the coaccused A3 was already released on bail and considering the incarceration period of the petitioners, prayed to enlarge them on bail.

4. The said contention of the learned counsel for the petitioner was objected by the learned Government Advocate (Criminal side) appearing for the respondent police stating that there are no allegations as against A3 for the possession of lethal weapons and he strongly objected the bail application on the ground that the 1st petitioner is having 6 previous cases and the 2nd petitioner is having 5 previous cases.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the past conduct of the petitioner and though the petitioners are under judicial custody since 21.05.2026, in the interest of the Society, this Court is of the firm view that it is not an appropriate stage to enlarge the petitioners on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 10-06-2026 MJS Note:
