O R D E R
This Criminal Original Petition has been filed seeking a direction to the first respondent police to monitor the investigation conducting by the second respondent police in Cr.No.198/2016 on the file of the 2nd respondent police.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. On a complaint lodged by one Saroja, that her husband Arumugam and his friend Subramani were assaulted by Balaji, the respondent police registered a case in Crime No.198 of 2016 dated 12.08.2016 for offences under Sections 294(b), 323 and 506(2) IPC against Balaji. The said Arumuugam and Subramani were admitted in the hospital, and unfortunately, Subramani died on 13.08.2016. Thereafter, the respondent police have altered the FIR and included Section 302 IPC and also, included one Udayakumar, who is the brother of Balaji, https://hcservices.ecourts.gov.in/hcservices/
as co-accused. At this juncture, the petitioner has, now, come forward before this Court for a direction to the Superintendent of Police, Villupuram/2nd respondent to monitor the investigation in Crime No.198 of 2016.
4. Taking into consideration the facts and circumstances of the case, the Superintendent of Police, Villupuram/ first respondent is directed to monitor the investigation that is being conducted by the Inspector of Police, Periyathatchur Police Station, Villupuram District, in Crime No.198 of 2016. With the above direction, this Criminal Original Petition is closed.
