ORDER

The petitioners, who were arrested and remanded to judicial custody on 03.08.2025 for the alleged offence under Sections 20(b)(ii)(c), 24 of NDPS Act, 1985 in Crime No.200 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that based on the secret information the respondent police went to the scene of occurrence and found that the petitioner along with other accused persons involved in illegal transportation of 350 kgs of ganja. Hence, this case.

3. The learned counsel appearing for the petitioners submitted that there is no recovery from this petitioner and only based on the confession statement the petitioner has been falsely implicated in this case. He also submitted that the petitioner is in judicial custody from 03.08.2025 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate appearing for the respondent Counsel for Government of Tamil Nadu (Crl Side) would submit that the petitioner is also a part of a network operating from Andhra Pradesh to Sri Lanka, involved in the possession, transportation and sale of ganja. He further submitted that this is the third bail petition and the earlier bail petitions filed by the petitioner in Crl.O.P.No.29975 of 2026 and Crl.O.P.No.2498 of 2026 was dismissed by this Court on 04.11.2025 and 04.02.2026 respectively. Hence, he opposed for grant of bail to the petitioner.

Heard both sides and perused the materials available on record. 6.Considering the facts of the case and nature of offence and the quantity involved in this case is 406 kgs which is a very huge quantity and the petitioner failed to satisfy twin conditions under section 37 of NDPS Act and this is the third bail petition and the earlier bail petitions filed by the petitioner was dismissed by this Court, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed.
