Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to register and conduct the elections for managing committee by secret ballot to Madeena Masjid situated at Plot No.115/125 Maruthi Nagar Main Road, Madambakkam, Chennai - 126 as sought in petitioner's representation dated 08.06.2018. O R D E R

The petitioner claims to be an instrument in constructing Madeena Masjid situated at Plot No.115/125 Maruthi Nagar Main Road, Madambakkam, Chennai. He also further claims to be one of the Jamathar of the Wakf. As the Mosque is not registered under the Tamil Nadu Wakf Board in compliance of the provisions of the Wakf Act, the petitioner has made several requests to the Managing Committee to register it with the Tamil Nadu Wakf Board. But the Managing Committee failed to accept his request to register the Mosque. The petitioner has also given a representation on 08.06.2018 to register the Mosque and thereafter, conduct the election by secret ballot. Aggrieved by the inaction, the petitioner has come to this Court by way of this Writ Petition seeking a direction to the respondent to register the Mosque and conduct election for the same by secret ballot.

2.The learned standing counsel taking notice for the respondent submitted that three months time may be granted to register the Mosque and also to conduct the elections. https://hcservices.ecourts.gov.in/hcservices/

3.In view of the above submission, the respondent is hereby directed to register the Mosque under the provisions of the Wakf Act and thereafter, conduct elections by secret ballot within three months in accordance with law.
