O R D E R

This Civil Revision Petition has been filed challenging the impugned order dated 08.04.2026 passed in I.A. No.13 of 2026 in RTROP No.42 of 2023 on the file of Principal District Judge, Namakkal. 2.Even though only at the instance of the petitioner, an Advocate Commissioner has been appointed by the Trial Court under the impugned order, the petitioner is aggrieved by the observation made by the Trial Court in the impugned order that the value of the red sander trees standing in the petitioner's land has to be valued as on the date of notification. 3.Learned counsel for the petitioner also relies upon the orders passed in favour of the petitioner in the Writ Petitions which are as follows:- (a) Order dated 28.04.2021 passed in W.P.No.10204 of 2021 (b) Order dated 16.06.2022 passed in W.P.No.28390 of 2021

4.According to the learned counsel for the petitioner, in the aforesaid Writ Petitions, it was made clear by the Writ Court that the petitioner is entitled for compensation for the value of the red sander trees at the fully grown stage. 5.This Court, after giving due consideration to the submissions made by the learned counsel for the petitioner as well as the grounds raised in this Writ Petition, is of the considered view that the petitioner can be directed to file Modification Petition before the Trial Court seeking for modification of the impugned order in the light of the submissions made by the learned counsel for the petitioner as well as the grounds raised by the petitioner in the Civil Revision Petition and a direction can be issued to the Trial Court to dispose of the modification application as and when filed, within a time frame to be fixed by this Court. Learned counsel for the petitioner is also satisfied if such a direction is issued by this Court.

6.Accordingly, this Civil Revision Petition is disposed of by directing the petitioner to file a Modification Application before the Trial Court seeking modification of the impugned order dated 08.04.2026, passed in I.A. No.13 of 2026 in RTROP No.42 of 2023 on the file of Principal District Judge, Namakkal, within a period of one week from the date of receipt of a copy of this

order. The Principal District Judge, Namakkal, shall entertain the said application and decide the same on merits and in accordance with law, after giving due consideration to the orders passed in the Writ Petitions as referred to supra and dispose of the same, within a period of four weeks from the date of receipt of modification application from the petitioner. However, there shall be no order as to costs.
