( Criminal Jurisdiction ) Monday, the Seventh day of December Two Thousand Twenty PRESENT The Hon`ble Mr Justice G.CHANDRASEKHARAN CRIMINAL MISCELLANEOUS PETITION No.542 of 2018 IN CRL RC.74/2018 P.GANESAN [ PETITIONER ] Vs K.DURAISAMY [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To grant exemption to the petitioner from the surrender by virtus of the Judgement dated 18.01.2017 made in C.A.No.31/2016 on the file of the Ist Additional District and Sessions Judge, Tiruppur, confirming the conviction and sentence imposed on him dated 08.02.2016 made in C.C.No.36/2012 on the file of the Judicial Magistrate (Fast Track Court), Tiruppur pending disposal of the Crl.R.C.No.74 of 2018.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.B.VIJAYAKUMAR, Advocate for the petitioner, the court made the following order:- It is represented by the learned counsel for the respondent that the petitioner has not deposited 50% of the cheque amount as directed by this Court in the order passed in Crl.M.P.No.541 of 2018 dated 22.01.2018.

2. The learned counsel for the petitioner submitted that he has got instructions from the petitioner that the money was deposited.

3. The learned counsel for the petitioner is directed to file proof to show that the 50% of the cheque amount was deposited before the learned I Additional District and Sessions Judge, Tiruppur on or before 14.12.2020.
