Thangaponnu v. The Managing Director

CMP No.14645 of 2019 in CMA (SR) No.66727 of 2019 R.MAHADEVAN, J.

This petition is filed by the petitioners / appellants / claimants seeking to condone the delay of 2288 days in filing the above Appeal.

2. Heard both sides. The learned Standing Counsel for respondent/Transport Corporation stated No objection in ordering this petition.

3. In view of the said submission, having regard to the reasons stated in the accompanying affidavit filed in support of this petition and being satisfied with the same, the delay of 2288 days in filing the above Appeal is condoned subject to the following conditions:- (i) The petitioners / appellants shall pay a sum of Rs.2,000/- as cost to the "Tamil Nadu Legal Services Authority, Chennai" on or before 15.10.2019; and (ii) The petitioners / appellants are not entitled to any interest for the default period, in the event of succeeding in the Appeal, in respect of the enhanced compensation amount.

4. This petition is ordered accordingly.
