Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd Respondent herein to dispose her representation dated 01.12.2021 to name transfer pertaining to the names of her father late Athaooa Gounder and her grand father late Appavu Gounder into her name in the revenue record Sunnambu Kuttai, Sankagiri Taluk, Salem District, (1) having an extent of 50 cents, comprised in survey no.400/3, (2) land having an extent of 50 cents, comprised in survey no.414/3, (3) land having an extent of 30 cents comprised in survey no.393/1, (4) water share in Survey no.394/5, (5) land having an extent of 1.00 acre comprised in survey no.381/2, (6) land having an extent of 25 cents comprised in survey no.393/1, (7) land having an extent of 1.81 acres in Survey no.360, as requested by her.

O R D E R

The petitioner herein seeks a direction to the 2nd respondent to consider her representation dated 01.12.2021 seeking transfer of patta in her name.

It is the case of the petitioner that the property comprised in S.Nos.400/3, 414/3, 393/3, 394/5, 381/2, 393/1, 391/5 and 360 situated at Devagoundanur Village, Sunnambu kuttai, Sankagiri Taluk, Salem District, originally belonged to her paternal grandfather and after death of her paternal grandfather and her father, she has been in possession and enjoyment of the same as a sole heir of her father. The petitioner submitted a representation dated 01.12.2021 seeking transfer of patta in her name in the capacity as a sole surviving heir. The same has not been considered. Therefore, the petitioner is before this Court.

3. Mr.U.Baranidaran, learned Additional Government Pleader, who is 2/4

taking notice for the respondents would submit that if petitioner submits an online application seeking transfer of patta, the same will be considered by the respondents within the time fixed by this Court.

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to direct the petitioner to submit an online application seeking transfer of patta in her name with necessary document within a period of two weeks from the date of receipt of a copy of this order. The 2nd respondent is directed to consider the online application of the petitioner and pass final orders on its own merit and in accordance with law, within a period of six weeks from the date of receipt of the application.

5. With the above direction, the Writ Petition stands disposed of. No costs.
