[Crime No.43 of 2026] ..Respondent PRAYER : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, praying to modify the condition that "Para No . 8(2) the petitioner on his release from prison, he shall appear before the respondent police station daily at 10.00 a.m., until further orders" in Crl.M.P.No.646 of 2026 dated 23.03.2026 passed by the learned Additional District Judge/ Presiding Officer, Special Court for EC Act Cases, Coimbatore and pass such other orders.

ORDER

This Criminal Original Petition has been filed to modify the condition that "Para No . 8(2) the petitioner on his release from prison, he shall appear before the respondent police station daily at 10.00 a.m., until further orders" in Crl.M.P.No.646 of 2026 dated 23.03.2026 passed by the learned Additional District Judge/ Presiding Officer, Special Court for EC Act Cases, Coimbatore.

The learned counsel for the petitioner submits that due to severe health issues, the petitioner travelled to Kerala to undergo Ayurvedic treatment under medical advice. Hence, the petitioner could not appear before the respondent police to comply with the condition. He further submits that the petitioner is ready and willing to comply with any modified condition that may be imposed by this Court.

The learned Government Advocate (Crl. Side) appearing for the respondent police submits that the petitioner has not reported before the respondent police even for a single day and complied with the condition. Hence, she prays for the dismissal of the petition.

Considering the submissions made by the learned Government Advocate (Crl. Side) and taking note of the petitioner's non-compliance in failing to report before the respondent police even for a single day, this Court is not inclined to allow the petition.
