ORDER

The petitioner, who apprehends arrest for the alleged offence under Section 303(2) of BNS, 2023 and 21(1) of Mines and Minerals Act, 1957 in Crime No.279 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that he was found in illegal possession of five units of river sand in a lorry. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has seven previous cases pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

From the submission of the learned counsel on either side, this Court is of the view that the petitioner has seven previous cases, which clearly demonstrates that the petitioner has misused the liberty granted by this Court and subverts the course of justice by repeatedly committing the similar offences. Further the present case involves the illegal exploitation of natural resources,

which has to be viewed seriously. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
