This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 05.06.2024, seeking bail in Crime No.309 of 2024 registered for the offence under Section 379 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 05.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail stating that, the accused, who was working as a contract labour under Lirbaser, had committed theft of 36 iron silt catch pits owned by the Chennai Corporation, which was worth about Rs.15 lakhs. He further submitted that the case is under investigation, no recovery was made from the accused and the CCTV footage is also available to connect the petitioner to this offence.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the facts that the investigation is not yet completed, no recovery was made from the accused so far and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
