ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) and 326(a) of BNS in Crime No.137 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner was involved in illegal transportation of one units of river sand without any valid permit or licence by using TATA Xenon Pickup load Auto and that the petitioner was caught red handed by the respondent police. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner was innocent and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and upon instructions, submitted that one previous cases is pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

6. From the submissions made by the learned counsel on either side, it is seen that the petitioner has got one previous case pending against him. Hence, considering the totality of the circumstances, this Court is of the firm view that

the this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 15-06-2026 SHL To:
