This Criminal Original Petition has been filed seeking to quash the proceedings in Crime No.371 of 2022 on the file of first respondent on the ground that there is compromise between the petitioner (A2) and the second respondent.
2. The First Information Report has been registered for offence u/s.397 IPC on the ground that the second respondent was threatened at knife point and his articles were stolen. The petitioner has been made as an accused in this case based on the confession given by A1. It is also stated that the petitioner was arrested by the respondent police in the course of investigation.
3. In a case of this nature, the First Information Report cannot be quashed on the ground of compromise since it is an offence against the interest of public. Hence, the investigation must go on in accordance with law. It is always left open to the petitioner to raise his defence if ultimately a final report is filed and the petitioner is also made to undergo trial before the concerned Court. This Criminal Original Petition is disposed of with the above direction. 2/4
