ORDER
The petitioner as complainant lodged a complaint before the first respondent and a case in Crime No.49 of 2026 for offence under Sections 212, 217, 236, 318(4), 338, 336(3) and 340(2) of BNS registered. 2.The complaint of the petitioner is that the petitioner completed her B.Com degree and her father is serving as a Pastor in a Church. She married one Alex Samson Sam on 12.01.2022 and there was a difference of opinion between them, hence, they got separated. The petitioner's husband filed a petition for restitution of conjugal rights in I.D.O.P.No.3024 of 2023 on 05.07.2023. When the said petition was pending for consideration, the petitioner's husband died on 13.02.2025 due to ill-health. Her in-laws suppressing the marriage between the petitioner with Alex Samson Sam, obtained death certificate as 'Unmarried'. The officials of Zone-IX, Corporation of Chennai issued a forged document, hence, a complaint filed.
3.The learned Government Advocate today filed a status report and submitted that there was some mistake occurred. The petitioner, Rhyma Gethsie is residing at Krishna Nagar, Rajakilpakkam, Chennai. She got married with Alex Samson Sam on 12.01.2022 and got separated during March, 2023. The
Alex Samson Sam filed a petition for restitution of conjugal rights in I.D.O.P.No.3024 of 2023 on the file of Principal Family Court, Chennai on 05.07.2023. Alex Samson Sam suffered illness and died on 13.02.2025. The parents of the deceased in collusion with the officials of Zone-IX, Greater Chennai Corporation suppressed the marriage of Alex Samson Sam with the petitioner and the same was also uploaded falsely. Based on the complaint, investigation conducted and death certificate of Alex Samson Sam collected. In the death certificate it was recorded as 'Unmarried'. Thereafter, the officials of Greater Chennai Corporation rectified the mistake by a rectification letter dated 14.05.2025 and now in the death certificate, the entry 'Unmarried' was deleted. In the death certificate issued on 14.05.
2025, it was shown that Alex Samson Sam died in Billroth Hospital on 13.02.2025, the name of the mother was recorded as 'Jesy Veena Sam' and father as 'Sam Selvaraj'. He further submitted that the petitioner's name not recorded in the place of wife, since in the hospital record the same was not provided. 4.Considering the submissions made and on perusal of the materials, this Court finds that the investigation in this case has been proceeded in the right direction. Hence, no further direction is required.
