Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondent herein to pay the death benefits of the petitioner's husband such as Commutation of Pension, Leave Surrender Pay, Family Welfare Fund, Pension arrears etc., with interest at 18% per annum from the date of death of the petitioner's husband viz., 23.9.2010 till date of payment to the petitioner herein.

O R D E R

The relief sought for in the present writ petition is for a direction to direct the respondent to pay the death benefits of the petitioner's husband such as Commutation of Pension, Leave Surrender Pay, Family Welfare Fund, Pension arrears etc., with interest at 18% per annum from the date of death of the petitioner's husband viz., 23.9.2010 till date of payment to the writ petitioner.

2. The learned counsel appearing on behalf of the respondent states that death benefits are already disbursed in favour of the writ petitioner and the balance dues are to be paid. It is further submitted that efforts are taken to settle the balance benefits as early as possible.

3. This Court is of the considered opinion that the death benefits are to be settled to the legal heirs without any https://hcservices.ecourts.gov.in/hcservices/

further delay. In the event of delay, the same would affect the livelihood of the entire family of the writ petitioner.

4. Under these circumstances, the respondent is directed to settle the balance death benefits to be paid to the writ petitioner, within a period of three months from the date of receipt of a copy of this order.
