A private complaint under Section 138 of Negotiable Instruments Act been taken cognizance by the trial Court on 10.01.2022. The matter was posted on 14.06.2024 for judgment. The trial Court has adjourned the matter further on that day. Now the case is posted to 09.07.2024 for Dr.G.JAYACHANDRAN,J.

Crl.O.P.No.15990 of 2024 rpl judgment. While so, the accused herein has presented the application through e-filing on 04.07.2024 at about 5.00 p.m., to reopen the defence witness. Immediately the present petition is filed before this Court contending that since the Advocates are boycotting the Court, the petition to reopen the case is to be considered by the trial Court before pronouncement of judgment.

This Court is unable to countenance the said plea the last hours the petition for reopen the case after posting the case for judgment been filed and even before the application taken consideration by the Court below, the petitioner has rushed to the High Court.
