Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to permit the petitioner to construct a bridge in vari porampokku situated at Survey No. 186 to access petitioner's property situated at Survey Nos.189/1, 190, 191 and 188/1 Kalaikkanayaicken Village, Perur Taluk, Coimbatore and pass orders.

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.Mr.R.Murthi, Government Advocate, takes notice for the first,third,fifth and sixth respondents. Mrs.C. Meera Arumugam, Additional Government Pleader takes notice for the fourth respondent. Mr.S.Senthil Murugan, Special, Government Pleader takes notice for the seventh respondent.

3.This writ petition is filed for a mandamus directing the respondent to permit the petitioner to construct a bridge in vari porambokku land situated at Survey No.186, Kalaikkanayaicken Village, Perur Taluk, Coimbatore. The petitioner and his sister jointly purchased the land measuring 13.31 acres, vide sale deed in Document Nos.2115/1974 in Survey no.189/1,190,191 at Kalaikkanayaicken Village, Perur Taluk, Coimbatore District. As it was found very difficult to access the land during the monsoon season, the petitioner and her sister decided to construct a bridge at their own expense. Therefore, the petitioner submitted a representation to the fifth respondent seeking permission to construct the bridge at vari porambokku land, situated at Survey No.

186, Kalaikkanaicken Village, Perur Taluk, Coimbatore, which was adjacent to the petitioner's property. The fifth respondent also granted permission to the petitioner to construct the bridge. The seventh respondent also in his communication dated 13.02.2023, recommended the construction of the bridge. Even the sixth respondent passed a resolution stating that there was no objection for constructing a bridge and the same was communicated to the petitioner.

from the PWD and Revenue Department. The petitioner also submitted a representation to the first respondent on 26.12.2023, seeking permission to construct the bridge on her own property. The first respondent on 21.03.2024, directed the second and fifth respondents, to submit a report. In the mean while, on 18.02.2024, the first respondent, sent a communication to the 4th respondent, and requested for no objection certificate for construction of the bridge based on the G.O.Ms.No.101, Water Resources Department, dated 30.09.2024. As none of the representations of the petitioner were considered, the petitioner was constrained to file the above writ petition for the above relief.

4. The learned counsel for the petitioner submitted that it would suffice if, a direction is issued to the fourth respondent to issue a No Objection certificate, based on the communication of the first respondent dated 18.10.2024, within the time frame fixed by this Court.

5. Considering the limited prayer sought for by the petitioner, this Court directs the fourth respondent to consider and pass orders on the 4 / 7

request of the petitioner for grant of No objection Certificate in pursuance of the communication sent by the first respondent dated 18.10.2024, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

6. Accordingly, this writ petition is disposed of. However, there shall be no order as to costs.
