ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.01.2026 for the alleged offences under Section 305(a) of B.N.S. in Cr. No.328 of 2025 on the file of the respondent police, seeks bail.

2. This is a case of theft of sandal wood trees from the compound of Sub Court Judges Quarters, Coimbatore and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has nothing to do with the commission of offences as alleged by the prosecution. The learned counsel would further submit that according to the prosecution, the petitioner has cut down the sandal wood trees from the judges' residence, however, the petitioner is not a named accused in the FIR and he has been remanded to judicial custody on 30.01.2026 and hence prayed to enlarge the petitioner on bail.

4. The learned Government Advocate (Criminal side) appearing for the respondent police would submit that the petitioner has 6 previous cases and the charge sheet has been filed and the case is pending in C.C. No.1325 of 2025 and therefore, he strongly objected the bail application.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submissions made by the learned Government Advocate and considering the past conduct of the petitioner, this Court is of the firm view that it is not desirable to consider the bail application and therefore, this Court is not

inclined to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. However, the Respondent Police is directed to take all the steps to produce the witnesses before the Court for the early completion of trial. 10-06-2026 MJS Note:
