ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 05.11.2020 for the offence punishable under Section 302 IPC r/w Sec 34 of IPC @ 302, 120(b), of IPC r/w 34 of IPC, in S.C.No.15 of 2021 on the file of the learned III Additional Sessions Judge, Puducherry in Crime No.323 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant was working as a vegetable vendor in Puducherry Market and having one daughter namely Kanchana and one son namely Gowtham/deceased and having criminal case against the deceased. Further, the petitioner along with other accused persons had murdered the son of the defacto complainant. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner has been in jail from 05.11.2020. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor (Puducherry) submitted that the petitioner along with other accused persons had murdered the son of the defacto complainant. He further submitted that the investigation has been completed and the charge sheet has also been filed. He further submitted that apart from this case, there are two previous cases pending against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner. 5.Considering the facts and circumstances of the case and also the fact that there are two previous cases pending against the petitioner and he has involved in very serious offence, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 05/10/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
