The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 324 and 506(ii) of IPC in Crime No.868 of 2022, seeks anticipatory bail.

2. Heard both sides.

3. The case of the prosecution is that the defacto complainant residing at Golden Nagar, Tiruppur, the people of Golden Nagar collected money for purchase of land to an extent of 3.45 cents for Mariamman Temple. The defacto complainant heard the information that the property going to be purchased in the name of Rajagopal, who is the brother of the petitioner, the same was questioning and opposed by the defacto complainant. On 29.07.2022, the defacto complainant have tea at Pavithra Bakery, at that thime, the petitioner came there, abused the defacto complainant and assaulted with knife and caused grievous injuries to him. Hence, the complaint.

4. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Therefore, he prays to grant anticipatory bail to the petitioner.

5. The learned Additional Public Prosecutor would submit that the petitioner has attacked the defacto complainant with knife and caused grievous injuries to him. He would further submit that the injured is still in hospital. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

6. Considering the nature of offence committed by the petitioner, and the injured is still in hospital, as custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition is dismissed. 05.08.2022 Lpp
