The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323 and 379 of IPC, in Crime No.498 of 2024, seeks anticipatory bail.
2. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case as though he has theft the vehicle of the defacto complainant, and whereas he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is a young professional advocate, for which, the defacto complainant has been foisted a false complaint against the petitioner. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Therefore, he prays to grant anticipatory bail to the petitioner.
3. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that there are one named accused/A1 petitioner herein and three unnamed accused in this case. He further submitted that the defacto
complainant is working as a driver in "A to Z fruits shop" and on the date of the incident, while the defacto complainant was loading watermelon into his vehicle, at that time, the petitioner waylaid the vehicle and abused him with filthy language, also assaulted him with hands and legs and then took away the vehicle. He further submitted that the property has not been recovered till now and the petitioner is still absconding. However, he vehemently opposed for the grant of anticipatory bail to the petitioner.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
5. Considering the nature of the offence committed by the petitioner and the property is not recovered till now and also considering the fact that the investigation is still pending, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.
