O R D E R

This petition has been filed to recall the warrant dated 13.04.2015 executed by the learned XXIII Metropolitan Magistrate at Chennai in PRC No.55 of 2011 for further examination.

2. The petitioner is facing prosecution in PRC No.55 of 2011 before the XXIII Metropolitan Magistrate, Chennai. Since the petitioner did not appear before the committal Court, non-bailable warrant is pending against him from 13.04.2015 onwards. While so, the petitioner has filed the present application to recall the non-bailable warrant.

3. In the opinion of this Court, in the light of Section 70 Cr.P.C., this petition is not maintainable and it is open to the petitioner to surrender before the Court and work out his remedies in the manner known to law.

Accordingly, this petition is dismissed.
