This application has been filed to condone the delay of 40 days in representation in filing the written statement of fourth defendant in D.No.12629 above suit.

2. Mr.K.sukumaran, learned counsel for respondents 1 to 3 would submit that he has no objection in allowing the present application.

Considering the averments made in the affidavit filed in support of this application and also taking into consideration that the learned counsel appearing for the respondent has no objection in allowing the present application and being satisfied with the same, the application is ordered as prayed for and the delay is condoned.
