The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the respondents to pay difference in leave salary and difference in gratuity as per 14th wage settlement dated 24.08.2022 with 10% interest to the petitioners.
2. It is the submission of the learned counsel for the petitioners that the petitioners are entitled for interest at the rate of 10% as per the 14th wage settlement dated 24.08.2022. He would further submit that they retired from service on 31.05.2022, and after their retirement, the respondents settled the retirement benefits based on the wage drawn on the date of retirement, without considering the 14th wage settlement. It is also the submission of the petitioners that in this regard, he had sent representations on 08.05.2025, and the same was not considered by the respondents. 2/5
3. At this juncture, the learned Standing Counsel appearing for the respondents would fairly submit that they would consider the said representations of the petitioners within a reasonable time.
4. Heard the learned counsel for both sides and perused the materials available on record.
5. In view of the said fair submission made by the learned Standing Counsel, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioners' representations dated 08.05.2025, and pass orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
6. In the result, this Writ Petition is disposed of with the above observations. No costs.
