ORDER

This Criminal Original Petition has been filed seeking a direction to the respondent Police to file a final report in Crime No.166/2025.

2. On the complaint lodged by the petitioner/de facto complainant, a case was registered in Crime No.166 of 2025 for the offence punishable under Section 318 of BNS. The First Information Report was registered on 08.10.2025 and thereafter, the petitioner was not called for enquiry and hence, he is not aware of the status of the complaint. Therefore, the present petition has been filed.

3. The learned Government Advocate (Crl. Side), on instructions, submitted that pursuant to the complaint lodged by the petitioner, investigation was completed and the case was closed as a mistake of fact in RCS.No.87 of 2026. It was further submitted that notice was attempted to be served on the petitioner, however, it was informed that the petitioner was not available at the given the address as he had gone abroad. The Referred Charge Sheet (RCS) has been filed before the Judicial Magistrate, Kodumudi and the case is posted on 10.08.2026.

4. The learned counsel for the petitioner submitted that the petitioner would appear before the concerned Magistrate and file protest petition.

5. Recording the submissions made by the learned counsel on either side, and in view of the fact that the closure report has already been filed before the Jurisdictional Magistrate, no further orders are required in the present petition.
