ORDER
This writ petition has been filed seeking a writ, in the nature of mandamus, directing the respondents 2 and 3 to consider the representation of the petitioner dated 01.03.2023 requesting for terminal benefits payable to her on account of the death of her son - K.Selvakumar who was working as Salesman in TASMAC shop at Paramathi Velur in Namakkal and died on 03.10.2018 while he was in service due to illness.
2. Heard both sides.
3. The grievance of the petitioner is that the respondents have not settled the retirement benefits payable to her on account of the death of her son, the government servant despite repeated requests. In fact, her representation dated 01.03.2023 to the respondents has not been considered so far.
4. The learned standing counsel for the 1st respondent TASMAC on instructions submitted that except gratuity all other amounts had been settled to the petitioner and it is for the respondents 2 and 3, who are competent authorities, to consider the same.
5. Service of notice is awaited on respondents 2 and 3. There is no representation for the respondents 2 and 3 despite service of private notice. 6. In the light of the above position and considering the nature of the relief sought for , without going into the merits of the claim of the petitioner, this court directs the respondents 2 and 3 to consider the representation of the petitioner dated 01.03.2023 and settle the benefits whatever payable and due to the petitioner within a period of one month from the date of receipt of a copy of this order.
This writ petition is disposed of accordingly with the above directions. No costs.
