Application No.4011 of 2021 in C.S.No.389 of 2021 has been filed by the first defendant seeking to condone the delay of 26 days in filing the affidavit of documents and list of witnesses in C.S.No.389 of 2021 and Application No.4012 of 2021 has been filed by the plaintiff seeking to condone the delay of 69 days in filing the affidavit of documents and list of witnesses in C.S.No.389 of 2021.

2. Learned counsels appearing for the respective respondents in both the applications have submitted that they have no objection for allowing these applications.

3. Recording the same, both these applications are allowed as prayed for.

4. Learned counsel for the plaintiff would submit that the plaintiff is aged 76 years and therefore, time frame may be fixed for recording of evidence before the learned Master.

5. Since the plaintiff is aged 76 years, this Court deems it fit to fix a time frame for recording of evidence by the learned Master. Post the matter before the learned Master for recording evidence on 15.12.2021.

6. Learned Master is directed to complete the recording of evidence of the parties on or before 30.06.2022.
