(Order of the Court was made by M.Duraiswamy, J.) By order dated 08.07.2022, this Court granted an order of interim stay on condition the petitioners/appellants depositing 50% of the decree amount together with accrued interest and costs to the credit of O.S.No.63 of 2020 on the file of the Principal District Court, Tiruppur within a period of four weeks from the date of receipt of a copy of the order. This Court also made it clear that in the event of the petitioners failing to deposit the said amount within the stipulated time would result in vacating the interim stay automatically without any further reference to this Court. 2.Now, the petitioners have come forward with the above Civil Miscellaneous Petition in C.M.P.No.12800 of 2022 seeking for extension of further time.
3.In the affidavit filed in support of the petition, though the petitioners have given some reasons seeking for extension of time, the learned counsel for the petitioners submitted that at least four weeks time Page 1/4
may be granted to the petitioners to comply with the orders of this Court dated 08.07.2022.
4.The learned counsel appearing for the respondents submitted that this Court had already granted four weeks time to the petitioners, hence, a week's time may be granted to the petitioners to comply with the order. 5.However, taking into consideration the reasoning given by the petitioners, we are inclined to grant two weeks time to the petitioners to comply with the order dated 08.07.2022. Accordingly, we extend the time granted by this Court in C.M.P.No.10798 of 2022 dated 08.07.2022, by two weeks, to deposit 50% of the decree amount together with accrued interest and costs to the credit of O.S.No.63 of 2020 on the file of the Principal District Court, Tiruppur, failing which the interim stay granted shall stand vacated automatically without any further reference to this Court.
We also make it clear that no further extension of time would be granted to the petitioners on any account, whatsoever.
