This Writ Petition has been filed to issue a Writ of Mandamus seeking a direction to direct the respondents to give adequate and necessary police protection to the petitioner and his family members by providing sufficient armed men with police Escort with necessary arrangements in Puducherry and also during his travels and during the pendency of investigation and trial.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor (Puducherry) appearing for the respondents and perused the materials available on record.
3. Learned counsel for the petitioner submitted that the
petitioner is the prime witness in Crime No.76 of 2025 on the file of the Lawspet Police Station, Puducherry. Pending investigation, life threat was made to the petitioner by the accused persons. Hence, the petitioner made representation before the respondent-officials for grant of police protection. Since there is no response from them, the petitioner is constrained to file this petition.
4. Learned Additional Public Prosecutor, (Puducherry) submitted that case in Crime No.76 of 2025 on the file of the Lawspet Police Station, Puducherry is under investigation.
5. Considering the facts and circumstances of the case and also considering the submission made by the learned counsel on either side, this Court directs the second respondent-Police to extend police protection to the petitioner/ prime witness in the case in Crime No.76 of 2025 on the file of the Lawpet Police Station, Pudupet till completion of investigation in Crime No.76 of 2025. Further, it is seen that the third respondent-Police is neither a necessary party nor a proper party in this
case, hence, the writ petition is dismissed as against the third respondent.
6. With the abovesaid direction, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. The petitioner is at liberty to move before the Trial Court after filing of the charge sheet. 04.07.2025 mfa Index:Yes/No Speaking Order: Yes/No
