ORDER
This criminal original petition has been filed to direct the respondent Police to register the FIR in view of the order passed by the learned Judicial Magistrate, Thittagudi, Cuddalore District in Crl.M.P.No.2979 of 2025 order dated 03.11.2025 in accordance with law.
2.The petitioner filed a complaint before the Judicial Magistrate, Thittakudi in Crl.MP.No.2979 of 2025 and the Judicial Magistrate by order dated 03.11.2025 directed the respondent police to cause preliminary enquiry and thereafter too, conduct an enquiry and to send a report within a period of one month. This order was passed during November, 2025 and till date, no action has been taken 3.The learned Govt. Advocate (Crl.Side) appearing for the respondent submitted that after receipt of the order from the Judicial Magistrate, summons were issued to the petitioner on 21.03.2026 and it is a dispute between brothers and sisters.
4.The learned counsel for the petitioner submitted that there was no summons served to him.
5. In view of the above, the petitioner is directed to appear before the respondent police on 18.06.2026 without fail and to cooperate with the investigation. If required thumb impression and also specimen signature for verifications to be obtained from the petitioner. The respondent police to conclude the enquiry on the complaint of the petitioner. If it is found that there is a cognizable offence made out, the respondent police to register FIR and
proceed with the case. In any event, the respondent police to submit a report before the Judicial Magistrate within a period of two months from the date of receipt of a copy of this order.
