CORAM:
THE HONOURABLE MR.JUSTICE RMT.TEEKAA RAMAN in C.R.P.SR.No.50102 of 2018 K.Durga Devi ... Petitioner .. Vs ..
V.R.Koteswaran ... Respondent Prayer :- Civil Miscellaneous Petition filed under Section 5 of the Limitation Act, to condone the delay of 34 days in filing the above civil revision petition.
For Petitioner : Mr.Sudharshana Sunder For Respondent : Mr.S.Ambigapathi - - - - -
ORDER
The above civil miscellaneous petition is preferred by the petitioner/wife seeking to condone the delay of 34 days in filing the above Civil Revision Petition against the order passed in I.A.No.1568 of 2016 in H.M.O.P.No.771 of 2014.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.
3. Learned counsel for the petitioner would submit that the petitioner has applied for the copy of the acknowledgment produced before the trial Court for the summons in H.M.O.P.No.771 of 2014 and hence, there was a delay of 34 days.
4. This Court finds that the delay of 34 days in filing the above civil revision petition is sufficiently explained. Accordingly, the above C.M.P.No.16835 of 2018 stands allowed on payment of costs of Rs.1,000/- to the respondent/husband payable by the petitioner/wife.
5. The Registry is directed to number the civil revision petition, if it is in order.
